I can't remember which website led me to this youtube clip.

It is a man named Steven Anderson, a Baptist pastor, recounting an experience with Border Patrol on April 14, 2009.

According to his statement, it started because he refused to answer their questions.

So, for Grand Poo-Bah, Jeff or others knowledgeable:

1. What am I required to do, by law, if questioned by law enforcement or other authorities?

2. Is this treatment a result of the Patriot Act...can a law take away constitutional protections like this?

3. I assume, if driving a vehicle, that the driver is required by law to show his/her driver's license and proof of insurance. Beyond that, one should assert one's 5th amendment right to remain silent?

4. At what point does a person demand an attorney?

I would appreciate hearing opinions on the account shared by this man. It seems to me that gross violations occurred to his constitutional rights.

Thanks for the link. I watched it and considered the times I've been pulled over.

"Wake up America, why is this happening in the United States of America."

The last line of his video -- frankly I"m appalled that the State Patrol guys would go along with the Border Patrol if the Border Patrol would not bring the dog back out a second time.

And I'd like an answer to gemstatemom's question also though I once asked an officer how much information you are required to give & his response was your license & registration. Basically, you do not have to talk to them at all even to tell them your name.

You know... I'm not an attorney here, but I don't believe that this man did anything wrong. Mark has a buddy who is a bigtime civil rights lawyer in moscow who would probably be better suited to answer this question.

I'll tell you this much, if I am ever detained illegally, I'm not answering a damn word without my lawyer present. Period, end of story.

Once again, the constitution is inconvenient, so we just ignore it. Know and understand your constitutional rights.

President Obama seems more concerned with how we treat terrorists at gitmo than how TSA and Border Patrol treat our own citizens. This simply smacks of fascism to me. It's scary.

I just watched the video, what a disgrace.

Imagine if this person had been a CWP holder and attempted to defend himself.

What are we supposed to do? This is so frustrating. What Glenn said yesterday about the beginning of the feedback loop is true. Folks, pray for your nation and pray for peace.

The topic (what you should do if questioned by the police) is discussed by Prof. James Duane in this video (http://www.youtube.com/watch?v=i8z7NC5sgik) which is quite informative. Judge Napolitano also has discussed it a number of times.

This video and it's part 2 (http://www.youtube.com/watch?v=08fZQWjDVKE) are GREAT videos!!!! Thanks for posting this link!

Now I just wish this guy went into more details about being asked to get out of the car, being detained, etc.

This guy seems like he is there to cause problems, but again... is he required to answer their questions? And are they required to answer his?

(Answers: 1. No, 2. Yes)

This seems like thuggery to me.
